[In the left margin] 518 Dorothy one feather bed and furniture for and during her own natural life and at her death, I give the same to said to Dorothy Drake's son Williams Drake. 3dly I give to said William Drake the tract of Land whereon I now live together with the Land I purchases of John W. Whitfield, and perhaps said deed of convetance from said Whitfield was also assigned by Jacob Barnes as Trustee and again I further give to said William Drake all that part of the land which I purchased of Henry Barrett and Adolphus Whitfield lying on the east side of the Fish Road to him the said William Drake and his heirs forever. I further give to said William Drake one Brandy still and one third of my per- sonal estate to him and his heirs forever 4thly I give to Elizabeth Phillips daughter of said Dorothy the track of land I purchased of Johnathon T Griffin trustee, which was formerly owned by the above name John Whitfield, further I give to said Elizabeth Phelps one third part of my personal estate to her said Elizabeth and her heirs forever. 5thly I give James Drake son of said Dorothy the remaining part of my real and person- al estate to him said James Drake and his heirs forever Nevertheless in case either of the above named Elizabeth Philips, James Drake, or William Drake shall die leaving no lawful issue of their bodies, my will is that the, survivor on survivors succeed to and enjoy Search deceased, ones legacy bequeath, and Support said, and then case all three of the above name Elizabeth Phillips James Drake and William Drake, should die neither of which leaves issue lawfully begotten of their bodies in that case by will is that the whole of my estate whole both real and personal desend to my nearest blood kindred or in other words, to desend to my Blood kindred in the same manner I had have died intestate Lastly I do hereby nominate and appoint my brother Jacob Barnes the Executor of this my last Will, hereby making void all former Wills by me made. This last will and testament of Thomas Barnes decd, was proved by the oath of James D Bryant and Susann Glover the witnesses thereto and ordered to be recorded. And on the motion of Jacob Barnes, the only executor therein named, who made oath and together with Britain Bryant Robert J Barnes and James Bryant his securities, enter onto and acknowledged a bond in the penalty of six thousannd dollars, condition as the law directs, certificate is granted for him for ob- taining a probate of the said Will in due form.
